The Sub-Committee considered an application for a licence in respect of the above premises.  The applicant was not in attendance despite telling the Licensing Manager that they intended to attend.  The Sub Committee decided to hear the application in their absence in accordance with Regulation 20(2)(b) of the Licensing Act 2003 (Hearings) Regulations 2005.  There was one person present on behalf of her partner who had made representation in favour of the application.

 

The Sub-Committee heard the application, and the representative for a person who had made representations in support of the application.  Members of the Sub-Committee and the parties present asked questions and received replies. 

 

Members noted the representations that had been made both in favour and objecting to the application.  It was also noted that three resident objectors and the statutory authorities had withdrawn their objections following two mediation meetings that had been arranged with the applicant.

 

Resolved: That, under section 100(A)(4) of the local Government Act 1972, the press and other members of the public be excluded from the meeting during consideration of the following item of business on the ground that it involves the likely disclosure of exempt information as defined in paragraph 5 of Schedule 12A of the Act, which would not be in the public interest.

 

The representative of a person who had made representations and the Council’s Licensing Officer then withdrew to enable the Sub-Committee, assisted by their Secretary and Legal Adviser, to consider the application and the representations that had been made.

 

The Licensing Sub-Committee took into account paragraphs 11.5 and 11.7 of the Councils Licensing Policy regarding licensing hours and that conditions should be appropriate and proportionate to the objections raised.

 

Resolved: (i) That application No. 15/00403/LAPREM be granted as submitted with the conditions offered by the Applicant at paragraph 2.2 of the report and the additional condition offered after mediation meetings at paragraph 6.2 of the report; that customers will only be permitted to smoke at the rear of the premises.

 

            (ii) This decision grants a licence under the Licensing Act 2003 only and it does not imply or require that other consents that the applicant may need under other legislation will be granted.

 

            (iii) Attention is drawn to the provisions in the Licensing Act 2003 for the possible review of the licence hereby granted.

 

The Licensing Sub Committee gave the following reasons:

 

1.    The Licensing Sub Committee took into account the style and nature of the premises, being a food-led cafe bar serving speciality beer with limited capacity and limited room for vertical drinking with an emphasis on quality rather than quantity.

 

2.    That the service was aimed at local clientele, commuters and families and being located close to the railway station allowed easy access without patrons having to use their cars.
