Election of Chair

Minutes:

Councillor Eric Allen proposed that Councillor Trish Fivey be elected as Chair for the duration of the meeting. This was seconded by Councillor Marlene Heron.

 

 Resolved: That Councillor Fivey be elected Chair of the Sub-Committee for the duration of the meeting.

Minutes:

Councillor Eric Allen declared a Non Pecuniary interest as he is a member of the LGA Stronger and Safer Communities Board and National Spokesman for Licensing.

The application seeks a new premises licence to authorise:

·         The sale by retail of alcohol for consumption on and off the premises from 09:00 until midnight Sunday to Thursday and 09:00 to 01:00 on the mornings following Friday and Saturday.

·         The provision of late night refreshment until midnight Sunday to Thursday and 01:00 on the mornings following Friday and Saturday.

·         Plays performance, Films exhibition, Live Music performance, Recorded Music performance Sunday to Thursday 09:00 to midnight and 09:00 to 01:00 on the mornings following Friday and Saturday.

·         Dance performance and Similar to live/recorded music or dance every day 09:00 to midnight.

Application by CryerArts Ltd

Application for a NEW PREMISES LICENCE

In respect of the premises known as Charles Cryer Theatre, 39 High Street, Carshalton

The Hearing

The Licensing Officer introduced the matter for determination and informed the Sub-Committee that CryerArts Ltd has applied for a new premise license in respect of the premises known as the CryerArts Centre, 39 High Street, Carshalton.

 

The application sought the grant of the following:

 

The sale by retail of alcohol for consumption on and off the premises from 09:00 until midnight Sunday to Thursday and 09:00 to 01:00 on the mornings following Friday and Saturday.

The provision of late night refreshment until midnight Sunday to Thursday and 01:00 on the mornings following Friday and Saturday.

Plays performance, Films exhibition, Live Music performance, Recorded Music performance Sunday to Thursday 09:00 to midnight and 09:00 to 01:00 on the mornings following Friday and Saturday.

Dance performance and similar to live/recorded music or dance every day 09:00 to midnight.

 

The Licensing Officer informed the Sub-Committee that the proposed hours of licensable activities and the hours of operation are laid out in Appendix 2.

 

The Licensing Officer explained that the applicant has advertised the application, as required, by way of a poster at the premises and by advertisement in a local newspaper and that the application had also been advertised on the Council’s website. One valid representation was received from Other Persons. The representations referred to matters that related to the prevention of public nuisance.

 

It was confirmed that all Responsible Authorities received a copy of the application.  Initial concerns were raised by the Trading Standards Officer and Noise Officer for Sutton Council, however these were resolved with the applicant resulting in revised conditions offered by the applicant and a reduction in the hours as set out at Appendices 2 and 3 of the report and a representation was not made. 

 

The Licensing Officer confirmed that copies of all representations have been forwarded to the applicant and have been made available to the Sub-Committee.

 

The Sub-Committee then heard a submission from  Rodger Molyneux-Roberts on behalf of the applicant, and the main points raised were:

 

CryerArts was selected by Sutton Council from a shortlist of 10 companies to take over the lease of the Charles Cryer Theatre. The process of acquiring and refurbishing the Charles Cryer Theatre has taken four years, and has cost over £160,000.

The theatre currently operates five days a week and closes on Monday and Tuesday due to ongoing building works.

Currently, the old license does not cover all the bar areas which CryerArts wishes to use, including two new bars which have been built during the refurbishment.
