Purpose of committee

Purpose

 

To promote and maintain high standards of conduct and probity for all councillors, co-opted members, other members of Council committees and joint committees, members of Council sponsored bodies, and Council representatives on other organisations, assisting those members to observe Sutton’s Code of Conduct, and considering allegations of breaches of Sutton’s Code of Conduct.

 

Composition

 

Five councillors appointed proportionately, at least two Independent Members and the Independent Person.

 

Only one member of the Strategy and Resources Committee may be a member of the Standards Committee.

 

The Leader of the Council may not be a member of the Standards Committee.

 

Appointment of external members

 

Independent Members of the Standards Committee, and the Independent Person, will be appointed following an advertisement placed in the local press by the Council requesting applications from persons wishing to serve in either capacity. Some experience of dealing with ethical propriety matters, experience of sitting on a quasi-judicial body and some knowledge of the workings of local government are considered useful. Independent Members and the Independent Person will not be entitled to vote at meetings.

 

The Chair shall be an independent Member.

 

Independent Members will be appointed at the Annual Council meeting for one year and may be re-appointed. An Independent Person, appointed in accordance with the Localism Act 2011, will serve on the Committee in an advisory capacity without voting rights. The Independent Person will be appointed for one year in the first instance and the appointment may be extended for a further period of two years.

 

Function

 

The function of the Standards Committee is:

 

1.    To promote and maintain high standards of conduct by members and co-opted members of the Authority, other members of Council committees and joint committees, members of Council sponsored bodies and Council representatives on other organisations.

 

2.    To assist members and co-opted members of the Authority, other members of Council committees and joint committees, members of Council sponsored bodies and Council representatives on other organisations to observe the Authority’s Code of Conduct.

 

3.    To advise the Authority on the adoption or revision of its Code of Conduct.

 

4.    To monitor the operation of the Authority’s Code of Conduct.

 

5.    To advise, train or arrange to train members and co-opted members of the Authority, other members of Council committees and joint committees, members of Council sponsored bodies and Council representatives on other organisations on matters relating to the Authority’s Code of Conduct.

 

6.    To monitor compliance with the Authority’s Code of Conduct.

 

7.    To have an oversight of the Constitution to ensure probity including the Commissioning Ethical Governance Audits.

 

8.    To have an oversight of the register of members’ interests.

 

9.    To receive an annual report on the Corporate Governance of the Council.

 

10.To make recommendations to and consider any recommendations from the Strategy and Resources Committee in respect of the Authority’s Code of Conduct.

 

11.To establish a Panel to consider and determine requests to grant dispensations to members with a Disclosable Pecuniary Interest to allow them to attend meetings from which they would otherwise be excluded in accordance with the provisions of the Localism Act.
