Councillor Shields proposed a motion to refuse the application on the same grounds of the previous refusal as detailed in paragraph 1.13 of the report where grounds for refusal was documented, as follows:
(1) The proposed development, by reason of the excessive height, width and depth of the proposed rear most outbuilding would result in a development which would not be proportionate to the size of the rear garden of the application site and would result in a dominant and overbearing form of development which would not respect the location context or character of the area and would result in harm to the visual amenity of the surrounding street block. As such the proposal is contrary to policy 28 of the Sutton Local Plan.
(2) The proposed development, by reason of the excessive height, width and depth of the rear most outbuilding in close proximity to the shared boundaries of the site would result in an overbearing and dominant form of development, and coupled with the siting and proximity of the smaller outbuilding on the shared boundary with 16 Clarkes Avenue would create an unacceptable sense of enclosure to both the rear gardens of 12 and 16 Clarkes Avenue. As such the proposal is contrary to policy 29 of the Sutton Local Plan.
